I am pissed. We had gotten letters from social security saying my husband's SSDI and SSI had both been approved. Have been getting deposits from both in our bank account. Today he got a letter denying him the SSI and saying they are going to take the back pay out of the SSI deposits. So if they weren't going to approve it, why did they? Ugh! So annoying!

Okay the back pay you have so many days before it is an asset right? Did you keep track of the bills you paid with it, most things are allowed?

did the SSI get approved 1st?

SSI is only paid if SS or SSDI is below a certain level. and your Income counts for that I think.

Are you his Representative Payee?

Lastly if the appeal stands, They have to set up a schedule that will be less harmful.

Yes, I am his representative payee. We did use a lawyer, but the last time I called them, they weren't helpful. They said the local office does not deal with any payments or anything like that. SSDI was approved first. I had been told the SSDI would supercede the SSI, so was surprised it was even approved. Oh, well, just meant we got his back pay (the SSI) early I guess. Did get it today, 4 months later, as everyone told me.

With the SSDI approved I expect he got on a medicaid type program. which is asset based $2000 in MN I think so make sure it is used the spend down for approved things, the SSI over-payment maybe allowed. my nephew bought a plot and stone, he may have a funeral account also.

Sounds to me like they made a mistake on approving the SSI, Look for the letter, I sure would appeal it. but ask questions, maybe can do an online chat, always check the box to have chat emailed to you.

Yeah, it sounds like mistakes were made. SSI is connected to Medicaid here. No SSI anymore, no Medicaid. SSDI approved, Medicare is a two-year wait. So we are paying out of pocket for medical care, which is why we can only afford a clinic, and thank goodness for that. At least we get very cheap medications. Social Security is federal government so can't do much.
